Please read these Terms and Conditions carefully before using our website or placing an order. They explain what you can expect from us and the terms that apply when you purchase goods from Asia Continental Limited.
Nothing in these Terms and Conditions affects your statutory rights as a consumer.
ONLINE TERMS AND CONDITIONS
1. Becoming a Customer
To place an online order with Asia Continental Limited, you must:
- Be at least 18 years old;
- Provide accurate and complete information;
- Have a delivery address within an area that we currently serve; and
- Use a valid payment method accepted by us.
We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including product unavailability, an inability to authorise payment, suspected fraud, an obvious pricing error or an inability to deliver to the address provided.
We may suspend or restrict an online account where we reasonably believe it has been misused or used fraudulently.
By placing an order with us, you agree to these Terms and Conditions.
Product Availability and Substitutions
All products are subject to availability.
If a product you order is unavailable, we may offer or provide a reasonably similar substitute where substitutions have been permitted by you.
Where possible, a substitute will be similar in type, size, quality and value to the original product.
Please be aware that substitute products may contain different ingredients or allergens. If you have allergies, intolerances or specific dietary requirements, you must carefully check the ingredients and allergen information of any substitute product before consuming it.
Where available, you may provide substitution preferences, allergy information or other relevant instructions during the ordering process.
If an unavailable product cannot be appropriately substituted, you will not be charged for that product or, where payment has already been taken, the appropriate amount will be refunded.
If a substitute is provided at a lower price than the original item, the appropriate price difference will be refunded or adjusted.
2. Your Online Account
You may create an Asia Continental online account to make future purchases more convenient.
You are responsible for keeping your account information and password secure and confidential.
You should inform us promptly if you believe that your account has been accessed without your permission or that your login details have become known to somebody else.
You are responsible for ensuring that your account information remains accurate and up to date, including your:
- Name;
- Email address;
- Telephone number;
- Billing information; and
- Delivery address.
Personal information relating to your account will be handled in accordance with our Privacy Policy.
We may retain information after an account is closed where this is necessary to comply with legal, accounting, tax, fraud-prevention or regulatory obligations.
3. Orders and Contract
Our website is operated by:
Asia Continental Limited
Company Number: 06309466
7–9 Sedgwick Street
Preston
PR1 1TP
Telephone: 01772 496992
Email: online@asiacontinental.co.uk
After you place an order, we will normally send an acknowledgement or confirmation to the email address you have provided.
This will usually contain details of:
- The products ordered;
- The amount charged;
- Applicable delivery charges;
- The delivery information supplied by you; and
- Your order reference.
An automated acknowledgement that we have received your order does not necessarily mean that your order has been accepted.
We reserve the right not to accept an order where there is a legitimate reason to do so, including where:
- A product is unavailable;
- Payment cannot be authorised;
- We suspect fraudulent activity;
- We cannot deliver to the address provided; or
- There is an obvious error in the product description or price.
Where we cannot accept your order after payment has already been taken, the relevant amount will be refunded.
You are responsible for checking that the email address, telephone number, delivery address and other information you provide are correct.
If you notice an error after placing an order, contact us as soon as possible.
4. Payments
Prices displayed on our website are in pounds sterling (£) and include VAT where applicable.
Any delivery, packaging or other applicable charges will be shown before you confirm your order.
Payment will be taken or authorised using the payment method selected during checkout.
Payments may be processed by a third-party payment provider. Asia Continental Limited does not directly store full debit or credit card details where payment is processed through our external payment provider.
We reserve the right to cancel an order if payment is declined, reversed or otherwise cannot be successfully processed.
5. Amending or Cancelling an Order
Because grocery orders may be picked, packed and dispatched quickly, please contact us as soon as possible if you wish to change or cancel an order.
Where possible, we allow requests to amend or cancel an order within 6 hours of the order being placed, provided that the order has not already been picked, packed, prepared or dispatched.
Requests should be sent to:
online@asiacontinental.co.uk
Please include your:
- Name;
- Order number;
- Delivery address; and
- Details of the change or cancellation requested.
We cannot guarantee that changes can be made after an order has entered the preparation or dispatch process.
The 6-hour operational cancellation period does not remove or restrict any separate cancellation rights you may have under consumer law.
Online Cancellation Rights
For qualifying non-perishable goods purchased online, you will normally have the right to inform us that you wish to cancel within 14 days of receiving the goods.
You will normally then have a further 14 days to return the goods.
Certain products are excluded from change-of-mind cancellation rights. This may include products which deteriorate or expire rapidly and certain sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed.
Your cancellation rights for change-of-mind purchases are separate from your legal rights where goods are faulty, damaged or not as described.
6. Prices, Offers and Promotions
The price charged for a product will normally be the price displayed on our website when you submit your order.
If we discover an obvious pricing error, we may contact you before fulfilling the order and give you the option to purchase the product at the correct price or cancel the affected item.
Promotions and Discounts
Promotions, discounts and special offers are subject to any conditions displayed alongside the relevant offer.
Unless stated otherwise, promotional offers are:
- Subject to availability;
- Available while stocks last;
- Limited to reasonable quantities; and
- Subject to any stated start and end dates.
Asia Continental Limited may withdraw, suspend or amend a promotion where reasonably necessary.
This may include:
- Percentage discounts;
- Money-off promotions;
- Voucher codes;
- Multibuy offers;
- Buy-one-get-one-free promotions;
- Delivery promotions; and
- Product-specific offers.
Where an offer is limited to one per person, account, household or order, we may enforce that restriction.
Promotional codes may be rejected where they are expired, invalid, used contrary to the promotional conditions or obtained or used fraudulently.
Changes to promotions will not affect rights which have already arisen under a completed purchase.
7. Delivery
Delivery services are subject to availability and may depend on your postcode, order size, product availability and courier availability.
Available delivery methods, charges and estimated delivery information will be displayed during the ordering process.
Please also refer to our separate Shipping Policy for further delivery information.
We will make reasonable efforts to deliver your order within the estimated timeframe provided.
Unless expressly stated as guaranteed, delivery times are estimates.
Delivery may occasionally be affected by circumstances outside our reasonable control, including:
- Severe weather;
- Road closures or traffic disruption;
- Vehicle breakdowns;
- Courier delays;
- Industrial action;
- Public emergencies;
- System failures; or
- Other unforeseen events.
Where reasonably possible, we will inform you of significant delays.
Your Delivery Address
You are responsible for providing a complete and accurate delivery address.
Please check your delivery information carefully before confirming your order.
We cannot accept responsibility for a failed or delayed delivery caused solely by incorrect or incomplete delivery information supplied by you.
Perishable Products
If your order contains fresh, chilled, frozen or otherwise perishable products, you should ensure that somebody is available to receive the delivery where necessary.
Perishable products should be refrigerated, frozen or otherwise appropriately stored as soon as reasonably possible after delivery.
If Nobody Is Available
If nobody is available to accept your delivery, the courier may follow the delivery instructions you have provided.
Depending on the delivery service and the products involved, the courier may:
- Leave the parcel in your nominated safe place;
- Leave it with a neighbour where permitted;
- Attempt redelivery;
- Deliver it to an appropriate collection point; or
- Return it to a depot.
If you nominate a safe place, you should ensure that it is secure, dry and suitable for the products ordered.
Where a parcel is returned because delivery could not be completed due to circumstances attributable to the customer, reasonable redelivery costs may apply.
Nothing in this section removes any responsibility Asia Continental Limited has under applicable consumer law while responsibility for the goods remains with us.
Flats and Apartments
Courier drivers may not always be able to carry large or heavy orders to individual flats or apartments.
If you have accessibility or mobility requirements which may affect delivery, please contact us before placing your order so that we can advise what assistance may be available.
Telephone: 01772 496992
Email: online@asiacontinental.co.uk
Multiple Parcels
Larger orders may be divided into two or more parcels.
Any additional delivery charges that apply will be communicated or displayed where required before you become liable for them.
8. Problems With Your Order
We want customers to be satisfied with the products and service they receive.
Please check your order as soon as reasonably possible after delivery.
Contact us promptly if a product is:
- Missing;
- Incorrect;
- Damaged;
- Spoiled;
- Faulty;
- Unsafe; or
- Not as described.
For fresh and perishable products, we recommend contacting us within 24 hours where reasonably possible so that we can investigate the problem effectively.
This 24-hour request does not limit or replace your statutory consumer rights.
We may reasonably ask you to provide photographs or other information relating to the affected item, such as:
- Product packaging;
- Batch information;
- Use-by or best-before dates; or
- Photographs showing the issue.
Depending on the circumstances and your legal rights, an appropriate remedy may include a refund, replacement, price reduction or other applicable remedy.
9. Returns and Refunds
Perishable Products
Because fresh and perishable products may deteriorate or expire rapidly, change-of-mind cancellation rights may not apply to them.
This does not affect your legal rights where a product is faulty, spoiled, unsafe, damaged or not as described.
Non-Perishable Products Purchased Online
For eligible non-perishable products purchased online, you may have a statutory right to cancel within 14 days of receiving the goods.
Once you notify us of your cancellation, you will normally have a further 14 days to return the relevant goods.
Products should be returned in reasonable condition.
Where legally permitted and made clear before purchase, you may be responsible for the direct cost of returning an unwanted product.
This does not apply where the product is faulty, incorrectly supplied or where the law otherwise requires us to bear the return cost.
Refunds
Approved refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed or required.
Where the statutory online cancellation right applies, refunds will be made within the time required by law.
Your bank or payment provider may require additional processing time before the refunded amount appears in your account.
10. Faulty Goods and Your Consumer Rights
Goods supplied by Asia Continental Limited must meet the standards required by applicable consumer law.
This includes requirements that goods are, where applicable:
- Of satisfactory quality;
- Fit for their intended purpose; and
- As described.
Nothing in these Terms and Conditions excludes or restricts these rights.
Where a product is faulty or fails to meet applicable legal requirements, you may have rights to a refund, repair, replacement, price reduction or other remedy depending on the circumstances.
Special rules may apply to highly perishable products because their expected usable lifespan may be shorter.
11. Allergies and Product Information
Food safety is important to us.
Allergen and ingredient information should be checked carefully before a product is consumed.
If you or somebody you are purchasing for has an allergy, intolerance or other dietary requirement, you should carefully inspect the information provided with the physical product.
Manufacturers may occasionally change:
- Recipes;
- Ingredients;
- Allergen information;
- Packaging; or
- Product specifications.
For this reason, you should not rely solely on historic product photographs or information displayed online where the physical product label provides updated information.
If you require further information before purchasing, please contact us:
01772 496992
online@asiacontinental.co.uk
12. Product Images, Descriptions and Weights
We take reasonable care to ensure that product descriptions, photographs and information displayed on our website are accurate.
Product images are provided for illustrative purposes and packaging may occasionally differ from that shown online due to changes made by manufacturers or suppliers.
Colours, labels, packaging and presentation may therefore vary.
This does not affect your rights where a product is materially different from its description.
Variable-Weight Products
Certain fresh, butchered, handmade or naturally variable products may vary slightly in weight, size or appearance.
Where an approximate weight is stated, reasonable variations may occur.
We will take reasonable steps to ensure that products supplied are consistent with the description and pricing information provided.
13. Liability
Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms limits or excludes liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation; or
- Your statutory rights in relation to faulty, unsafe or misdescribed goods.
Asia Continental Limited will not normally be responsible for losses that were not reasonably foreseeable when the contract was entered into or which were not caused by our breach of these Terms.
Products purchased as a consumer are supplied primarily for private and domestic use unless otherwise agreed.
Where deterioration or damage occurs because products have been improperly stored or handled after delivery and after responsibility for the goods has lawfully passed to the customer, we will not be responsible for deterioration caused by that improper handling or storage.
14. Website Availability
We aim to keep our website operating and available.
However, we cannot guarantee uninterrupted access at all times.
Access may occasionally be restricted or unavailable because of:
- Website maintenance;
- Repairs;
- Software updates;
- Technical faults;
- Security measures; or
- Events outside our reasonable control.
We will take reasonable steps to restore normal access as soon as reasonably possible.
15. Account Deletion
You may request deletion of your online account by contacting:
online@asiacontinental.co.uk
Account deletion requests will be handled in accordance with applicable data protection law.
Certain information may need to be retained after your account is deleted where there is a lawful reason to retain it, including for:
- Accounting and tax records;
- Fraud prevention;
- Legal claims;
- Regulatory requirements; or
- Other legal obligations.
Please refer to our Privacy Policy for further information about how we collect, use and retain personal information.
16. Intellectual Property
Unless otherwise stated, content made available through the Asia Continental website is owned by, licensed to or lawfully used by Asia Continental Limited or the relevant rights holder.
This may include:
- Text;
- Graphics;
- Logos;
- Photographs;
- Videos;
- Icons;
- Website design;
- Page layouts;
- Databases;
- Software; and
- Other website content.
Such material may be protected by copyright, trademark and other UK or international intellectual property laws.
You may not reproduce, distribute, commercially exploit, modify or republish protected website material without permission from the relevant rights holder, except where permitted by law.
Third-Party Intellectual Property
Some product photographs, trademarks, descriptions and other material may be owned by manufacturers, distributors, suppliers or other third parties.
Ownership of those materials remains with the relevant rights holder.
Links to Other Websites
Our website may contain links to websites operated by independent third parties.
Unless expressly stated otherwise, those websites are not controlled by Asia Continental Limited.
We are not responsible for the content, security, availability or privacy practices of independent third-party websites.
The presence of a link does not necessarily mean that we endorse that website, business, product or service.
17. General Terms
These Terms and Conditions, together with policies expressly referred to within them, set out the terms governing purchases through our website.
If we do not immediately exercise a right available to us under these Terms, this does not mean that we have waived that right.
We may update our website, policies and Terms and Conditions from time to time.
Changes will not normally alter rights or obligations that have already arisen under an existing contract unless required or permitted by law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply where legally possible.
These Terms and Conditions are governed by the laws of England and Wales.
Nothing in this section prevents a consumer from exercising any rights regarding jurisdiction or bringing proceedings that are available to them under applicable law.
ASIA CONTINENTAL IN-STORE TERMS AND CONDITIONS
18. Application of In-Store Terms
These terms apply to purchases made in person from:
Asia Continental Limited
Company Number: 06309466
7–9 Sedgwick Street
Preston
PR1 1TP
These provisions apply specifically to in-store purchases and should be read alongside the applicable statutory rights of customers.
19. Fresh and Frozen Products
For hygiene, food safety and product-quality reasons, we do not normally accept change-of-mind refunds or exchanges for fresh, chilled or frozen products once they have been purchased and removed from the store.
This includes, but is not limited to:
- Fresh meat and poultry;
- Seafood;
- Dairy products;
- Fresh fruit and vegetables;
- Chilled products; and
- Frozen foods.
This restriction relates to change-of-mind returns only.
It does not affect your statutory rights where goods are faulty, spoiled, unsafe or not as described.
20. Non-Perishable and General Merchandise
For non-perishable, ambient and general merchandise products, including canned goods and household items, Asia Continental may offer a refund or exchange within 14 days of purchase where you have simply changed your mind, provided that:
- The item is returned in its original condition;
- Original packaging is retained where applicable;
- Valid proof of purchase is provided; and
- The product has not been used, opened, damaged or altered.
This is our voluntary change-of-mind policy and is separate from your statutory rights relating to faulty goods.
21. Faulty, Damaged or Misdescribed Goods
If you believe a product purchased from Asia Continental is faulty, spoiled, unsafe, damaged or not as described, please return it to the store or contact us as soon as reasonably possible.
For fresh or perishable products, reporting an issue promptly helps us investigate the quality of the product.
Where possible, please retain the product and its packaging and provide proof of purchase.
We may also ask for relevant information such as the batch number, best-before or use-by date, or photographs of the problem.
Where goods do not meet the standards required by consumer law, you may be entitled to an appropriate statutory remedy.
Nothing in our store policy imposes an arbitrary time limit that removes rights you have under consumer law.
22. Taste and Personal Preference
A product is not necessarily faulty simply because you dislike its:
- Taste;
- Flavour;
- Texture;
- Appearance; or
- Other subjective characteristic.
Where a product is safe, of satisfactory quality and accurately described, we may decline a refund where the concern relates solely to personal preference.
This does not apply where there is evidence of an actual quality, safety or description problem.
For concerns relating specifically to a manufacturer’s recipe or characteristics of a branded product, we may recommend that you also contact the manufacturer using the information provided on the packaging.
23. Receipts and Proof of Purchase
Please retain your receipt.
For refunds and exchanges, we may request reasonable evidence that the goods were purchased from Asia Continental.
An original receipt will normally provide the clearest proof of purchase.
Where a receipt is unavailable, other reasonable evidence of purchase may be considered where appropriate or where required by law.
24. Manager’s Discretion
Voluntary refunds or exchanges for change-of-mind purchases may be subject to management approval and the conditions of our returns policy.
Management may refuse a voluntary return where those conditions have not been met.
Managerial discretion does not override or reduce a customer’s statutory consumer rights.
25. Promotions and Sale Items
Products sold as part of a promotion, special offer or clearance may be subject to specific promotional conditions displayed at the time of purchase.
Where clearly stated, some promotional or clearance products may be excluded from our voluntary change-of-mind returns policy.
This does not affect your statutory rights where an item is faulty, unsafe or not as described.
26. Store Safety and Hygiene
Customers must behave responsibly while on our premises and follow reasonable instructions given by staff for health, safety and security purposes.
Children should be appropriately supervised while in the store.
Food products should not be opened or consumed before purchase unless expressly permitted.
Customers must not interfere with, damage or tamper with products, packaging, equipment or store property.
27. Contact Us
If you have a question, complaint, return request or other enquiry, please speak to a member of staff in-store or contact:
Asia Continental Limited
Company Number: 06309466
7–9 Sedgwick Street
Preston
PR1 1TP
Telephone: 01772 496992
Email: online@asiacontinental.co.uk
28. Changes to These Terms
Asia Continental Limited may amend these Terms and Conditions from time to time to reflect changes to our services, business practices or legal requirements.
The version applicable to an online purchase will normally be the version in force when the relevant contract is formed.
Nothing in any amendment will remove rights already available to a customer under applicable consumer law.
